COMPREHENSIVE PRIVACY NOTICE
- Responsible for the Processing of your Personal Data
Alain Brault Laurin, operating under the commercial name Ocean & Town Vallarta Realty™ (hereinafter referred to as “The Real Estate Agent”), with physical address located at: Sor Juana Ines 219, Col. El Caloso, Puerto Vallarta, Jalisco, 48360 Mexico, and with official website: oceantownvallarta.com, is responsible for the use, treatment and protection of your personal data, committing to safeguard them under the highest standards of technical security, administrative and physical.
- Personal Data to be collected
In order to comply with the purposes described in this notice, ” The Real Estate Agent ” will collect the following categories of personal data through its web forms, telephone calls or face-to-face interviews:
- Identification Data: Full name, marital status, handwritten signature, Federal Taxpayer Registry (RFC), Unique Population Registry Code (CURP), place and date of birth, nationality, and copy of valid official identification (INE or Passport).
- Contact Details: Home address, email, landline and cell phone.
- Patrimonial and Financial Data: Bank account information, account statements, proof of income, credit history, public deeds of real estate, proof of payment of services and taxes related to properties.
Note on Sensitive Personal Data: ” The Real Estate Agent ” formally declares that it does not request or process sensitive personal data (those that affect the most intimate sphere of its owner, such as racial origin, state of health, religious, philosophical or moral beliefs, union membership or political opinions).
- Purposes of Data Processing
The personal data we collect from you will be used for the following purposes, divided according to their obligatory nature:
A. Primary Purposes (Necessary for the requested service):
- Provide professional advice and real estate intermediation for the purchase, sale or lease of real estate.
- Verify and confirm the identity of the clients, as well as the legal and tax situation of the properties promoted.
- Comply with the Federal Law for the Prevention and Identification of Operations with Resources of Illicit Origin (LFPIORPI) or “Anti-Money Laundering Law”, through the integration of customer identification files in operations considered Vulnerable Activities.
- Comply with the Federal Consumer Protection Law and the guidelines issued by PROFECO, including the use of duly registered official adhesion contracts.
- Prepare promise contracts, purchase and sale, lease, letters of offer and other necessary legal documents.
- Coordinate procedures before notaries public, financial institutions, mortgage brokers or government agencies.
B. Secondary Purposes (Marketing or Advertising Purposes):
- Send newsletters with offers and new property options available.
- Send advertising, pre-sale promotions or services from allied companies (mortgage loans, removals, insurance).
- Conduct satisfaction surveys to evaluate the quality of the service provided by our advisors.
- Carry out a post-sale follow-up or send greetings.
If you do not wish your personal data to be processed for these secondary purposes, you can express your refusal from this moment by sending an email to: alain.brault@oceantownvallarta.com . Refusal to use these purposes may not be a reason for us to deny you the real estate services you request.
- Transfer of Personal Data
We inform you that your personal data may be shared inside and outside the country with the following third parties, authorities and organizations, without requiring your explicit consent as these are legal exceptions:
- Financial Intelligence Unit (UIF) and Tax Administration Service (SAT): To strictly comply with the reporting obligations set forth in the Anti-Money Laundering Law.
- Notaries Public: To carry out the formalization, deed and closing of purchase and sale operations.
- Financial or Banking Institutions: For the management, processing and validation of mortgage loans requested by the client.
- PROFECO: Only in response to official requirements related to the validation of consumer rights.
- Means to Exercise ARCO Rights
You have the right to know what personal data we hold about you, what we use it for and the terms of use we give it (Access). Likewise, it is your right to request the correction of your personal information in case it is outdated, inaccurate or incomplete (Rectification); that we delete it from our records or databases when we believe that it is not being used properly (Cancellation); as well as to oppose the use of your personal data for specific purposes (Opposition).
To exercise any of the ARCO Rights, you must send a formal written request to the email: alain.brault@oceantownvallarta.com
The application must contain:
- Full name of the data subject.
- Email or physical means of receiving notifications.
- Digitized copy of your current official identification (INE or Passport) to prove your identity.
- Clear and precise description of the personal data with respect to which you seek to exercise any of the ARCO rights, detailing which right you wish to apply.
” The Real Estate Agent ” will notify you of the decision adopted within a maximum period of 20 (twenty) business days from the date of receipt of the request. If appropriate, it will be effective within 15 (fifteen) business days following the date on which the response was communicated.
- Mechanisms for Revocation of Consent
You may revoke the consent you have given us for the processing of your personal data. However, it is important that you bear in mind that not in all cases we will be able to attend to your request or conclude the use immediately, because the Anti-Money Laundering Law requires us to keep the identification files for a minimum period of 5 years after the conclusion of the real estate operation.
To revoke your consent, you must send your request to the email: alain.brault@oceantownvallarta.com following the same identification requirements indicated in the previous section.
- Limitation of Use or Disclosure of Personal Data
In order for you to limit the use and disclosure of your personal information for advertising purposes, we inform you that you can register in the Public Registry to Avoid Advertising (REPECO) with PROFECO. For more information about this registry, you can consult the official portal of said institution.
- Modifications to the Privacy Notice
This privacy notice may be modified, changed or updated as a result of new legal requirements, our own business needs or changes in our business model.
